Terms & Conditions

Last updated: November 2026. Please read these Terms and Conditions carefully before engaging Major Laser for any laser cleaning services. By requesting a quote, accepting a proposal, or allowing work to commence, you agree to be bound by these terms.

1. Definitions

  • "Company" means ProLaser Restoration (Pty) Ltd, trading as Major Laser.
  • "Client" means any individual, business, or entity that engages the Company for services.
  • "Services" means laser cleaning, surface preparation, rust removal, paint/coating removal, grease/oil removal, soot removal, graffiti removal, and weld preparation services provided by the Company.
  • "Quote" means a written or electronic estimate provided by the Company for the performance of Services.
  • "POPIA" means the Protection of Personal Information Act 4 of 2013.

2. Service Terms

  • All Services are provided on the basis of a Quote accepted by the Client. No work will commence without prior agreement on scope and price.
  • The Company reserves the right to decline any job at its sole discretion, including where safety risks, access limitations, or unsuitable substrate conditions are identified.
  • The Client is responsible for ensuring safe and unobstructed access to the work area. Delays caused by restricted access may result in additional charges.
  • Laser cleaning is a precision process. Results depend on substrate condition, coating type, and contamination level. The Company will advise on expected outcomes prior to commencement but cannot guarantee identical results across all surfaces.
  • The Client must disclose all known hazards, coatings, or substances present on surfaces to be cleaned before work begins. Failure to disclose may result in additional costs or termination of the job.
  • The Company operates a mobile service across the West Coast of South Africa. Travel to sites outside the standard service area (Langebaan and surrounds) may attract a travel surcharge, which will be included in the Quote.

3. Payment Terms

  • Payment is due upon completion of Services unless otherwise agreed in writing. For larger projects, the Company may require a deposit of up to 50% before work commences.
  • Invoices are payable within 7 (seven) calendar days of the invoice date unless a different payment period is stated on the invoice.
  • The Company accepts payment by EFT (Electronic Funds Transfer). Banking details will be provided on the invoice. The Company does not accept cash for amounts exceeding R5 000.
  • Late payments will attract interest at the rate of 2% per month (or the maximum rate permitted by law, whichever is lower) calculated from the due date until the date of full payment.
  • All prices quoted are exclusive of VAT unless expressly stated otherwise. VAT will be added at the applicable rate where the Company is registered as a VAT vendor.
  • The Company reserves the right to withhold completion of Services or remove equipment from site if payment obligations are not met.

4. Cancellation & Rescheduling

  • The Client may cancel or reschedule a confirmed booking by giving at least 48 hours' written notice (via email or WhatsApp) at no charge.
  • Cancellations made with less than 48 hours' notice may be subject to a cancellation fee of up to 25% of the quoted job value to cover mobilisation costs.
  • If the Company is unable to attend a scheduled job due to equipment failure, weather conditions, or other circumstances beyond its reasonable control, the Company will notify the Client as soon as practicable and reschedule at no additional cost.
  • Where a deposit has been paid and the Client cancels with less than 48 hours' notice, the Company reserves the right to retain the deposit as a cancellation fee.
  • Jobs cancelled by the Company for safety reasons (e.g. hazardous materials discovered on site) will be refunded in full.

5. Liability & Indemnity

  • The Company will exercise reasonable care and skill in performing all Services. However, the Company's liability for any claim arising from the Services is limited to the value of the invoice for the specific job giving rise to the claim.
  • The Company is not liable for pre-existing damage, latent defects, or deterioration of surfaces that becomes apparent during or after laser cleaning.
  • The Client indemnifies the Company against any loss, damage, or claim arising from inaccurate or incomplete information provided by the Client regarding the substrate, coatings, or site conditions.
  • The Company is not liable for any consequential, indirect, or special damages, including loss of production, loss of profit, or business interruption, howsoever arising.
  • Nothing in these Terms limits liability for death or personal injury caused by the Company's gross negligence or wilful misconduct.

6. Health & Safety

  • The Company complies with applicable occupational health and safety legislation, including the Occupational Health and Safety Act 85 of 1993.
  • The Client must ensure that the work area is safe for the Company's personnel and equipment prior to commencement of Services.
  • Bystanders and unauthorised persons must be kept clear of the work area during laser cleaning operations. The Client is responsible for enforcing this requirement on their premises.
  • The Company's personnel are authorised to stop work immediately if they identify an unsafe condition. No penalty or charge will apply for stoppages due to genuine safety concerns.

7. Personal Information (POPIA)

  • The Company collects and processes personal information (name, contact details, address, and job-related information) solely for the purpose of providing Services, issuing invoices, and communicating with the Client.
  • Personal information is handled in accordance with POPIA and the Company's Privacy Policy, available at majorlaser.co.za/privacy-policy.
  • The Company will not sell, rent, or share personal information with third parties except where required by law or necessary to perform the Services (e.g. sharing a site address with a subcontractor).
  • Clients have the right to request access to, correction of, or deletion of their personal information held by the Company. Requests may be directed to info@majorlaser.co.za.

8. Intellectual Property

  • All photographs, videos, and documentation produced by the Company during or after the performance of Services remain the property of the Company and may be used for marketing, training, or portfolio purposes.
  • Where the Client objects to the use of site-specific imagery, they must notify the Company in writing before work commences.

9. Governing Law & Disputes

  • These Terms are governed by the laws of the Republic of South Africa.
  • Any dispute arising from these Terms or the Services will first be referred to good-faith negotiation between the parties. If unresolved within 14 days, either party may refer the matter to mediation or, failing that, to the Magistrate's Court or High Court with jurisdiction.
  • The Client consents to the jurisdiction of the courts of the Western Cape, South Africa.

10. General

  • These Terms constitute the entire agreement between the Company and the Client regarding the Services and supersede all prior representations, warranties, or agreements.
  • No variation of these Terms is binding unless agreed in writing and signed by an authorised representative of the Company.
  • If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions continue in full force and effect.
  • The Company reserves the right to update these Terms at any time. The current version will always be available at majorlaser.co.za/terms.
